Acceptance of Terms
By engaging The Threefold Collective ("we", "us", or "our") for design services, or by accessing our website at thethreefoldcollective.com, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not proceed.
The Threefold Collective is a digital design studio based in the Philippines. These terms apply to all clients, whether based locally or internationally.
Services
The Threefold Collective provides premium digital design services including, but not limited to:
- Custom website design and development.
- Landing page and sales funnel design.
- Website revamps and digital presence strategy.
- Brand presentation and document design.
All project scopes, deliverables, timelines, and pricing are confirmed in writing before work commences. Any changes to agreed scope after a project has begun may be subject to additional fees and a revised timeline.
Payment Terms
Payment terms are agreed upon individually at the time of project confirmation. Unless otherwise stated in writing:
- A deposit (typically 50% of the project total) is required before work begins.
- The remaining balance is due upon project completion, prior to the release of final files.
- Invoices are payable within 7 days of issue.
- Late payments may result in work being paused until the outstanding balance is cleared.
Projects are invoiced in the currency agreed upon at the time of engagement. International clients may be subject to bank transfer or exchange fees, which are the client's responsibility.
Revisions & Approvals
Each project includes a defined number of revision rounds as specified in the project agreement. Revisions beyond the included allowance will be scoped and invoiced separately.
Client approval at each milestone is required before proceeding to the next stage. Delays in feedback or approvals from the client's side may affect the agreed delivery timeline.
Intellectual Property
Upon receipt of final payment in full, the client receives full ownership of the final deliverables created specifically for their project.
The Threefold Collective retains the right to:
- Display completed work in our portfolio, case studies, and marketing materials, unless the client requests confidentiality in writing.
- Retain ownership of any design concepts, drafts, or explorations not selected or included as final deliverables.
- Retain rights to any proprietary frameworks, tools, or code structures used across multiple client projects.
Third-party assets (typefaces, stock photography, plugins, or licensed tools) remain subject to their respective license agreements. Ongoing licensing obligations become the client's responsibility upon project handoff.
Client Responsibilities
The client agrees to:
- Provide accurate, timely, and complete content, assets, and feedback as required.
- Ensure all supplied materials — including copy, images, and branding — are legally owned or appropriately licensed.
- Designate a clear point of contact for the duration of the project.
- Review and respond to requests within agreed timeframes.
The Threefold Collective accepts no liability for project delays or issues arising from incomplete, inaccurate, or late client input.
Confidentiality
Both parties agree to keep confidential any proprietary, strategic, or sensitive information shared during the course of a project. This obligation remains in effect after the project concludes. Neither party will disclose the other's confidential information to any third party without prior written consent.
Disclaimer of Warranties
Our services are provided in good faith and with professional care. However, The Threefold Collective makes no guarantee that any website or digital product will achieve specific business outcomes, conversion rates, search rankings, or revenue results. Design performance depends on many factors — including your offer, audience, and market conditions — that are beyond our control.
Limitation of Liability
To the fullest extent permitted by applicable law, The Threefold Collective's total liability for any claim arising from our services is limited to the amount paid by the client for the specific project in question.
We are not liable for any indirect, consequential, incidental, or special damages — including lost revenue, lost data, or business interruption — arising from the use of our deliverables or services.
Termination
Either party may terminate a project agreement with written notice. In the event of termination:
- All work completed to the point of termination will be invoiced at the agreed rate or a fair pro-rata equivalent.
- Any deposit paid is non-refundable unless otherwise agreed in writing prior to commencement.
- Ownership of all work-in-progress files remains with The Threefold Collective until outstanding balances for completed work are settled in full.
Governing Law & Disputes
These Terms and Conditions are governed by the laws of the Republic of the Philippines. Any disputes arising from our services or these terms shall be subject to the jurisdiction of the appropriate courts in the Philippines.
For international clients, we will always seek to resolve disputes amicably and in good faith before any formal legal proceedings. Where required by applicable law in your jurisdiction, your local consumer protection rights are not affected by these terms.
Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. The most current version will always be published at thethreefoldcollective.com. Continued engagement with our services after an update constitutes acceptance of the revised terms.
