Acceptance of Terms

By engaging The Threefold Collective ("we", "us", or "our") for design services, or by accessing our website at thethreefoldcollective.com, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not proceed.

Ophelia Barba-Manuson, trading as The Threefold Collective, Philippines. These terms apply to all clients, whether based locally or internationally. A legally appropriate service address remains to be confirmed before final publication.

Services

The Threefold Collective provides premium digital design services including, but not limited to:

All project scopes, deliverables, timelines, and pricing are confirmed in writing before work commences. Any changes to agreed scope after a project has begun may be subject to additional fees and a revised timeline.

Payment Terms

Unless a signed proposal or agreement expressly states otherwise, the following general project payment schedule applies:

Projects are invoiced in the currency agreed upon at engagement. International bank, transfer or exchange fees are the client's responsibility unless agreed otherwise. This wording is a commercial summary and remains subject to professional legal review before final publication or reliance.

Website Review — Scope and Booking

The Website Review covers up to five priority public pages on one website/domain. It includes one recorded walkthrough, one written prioritised action plan and one 20-minute follow-up call. Login-only and gated pages are excluded during soft opening, and implementation is excluded unless agreed in writing.

The 3–5 business-day delivery period begins only after cleared payment and receipt of all required information and access. A request does not reserve a place. A place is confirmed only after scope approval and cleared payment. The first-10 limit counts confirmed paid review bookings.

This is not legal or compliance advice, certified accessibility testing, penetration testing, a security audit, a complete SEO or keyword strategy, analytics attribution, or proof of why sales changed. Automated and human observations are bounded and may not identify every issue.

Factual corrections may be requested within seven days of delivery. Repeated revised reviews and implementation are not included. One follow-up call is included; it may be rescheduled once with at least 24 hours' notice, and one courtesy rebooking is available within seven days after a missed call.

Cancellation and refund treatment remains governed by the signed service agreement and applicable law, pending professional legal review. No hosted payment is currently connected through this website. The Website Review is a complete standalone service at the US$173 soft-opening rate, paid in full before work begins, with no obligation to hire Threefold afterward.

Revisions & Approvals

Each project includes a defined number of revision rounds as specified in the project agreement. Revisions beyond the included allowance will be scoped and invoiced separately.

Client approval at each milestone is required before proceeding to the next stage. Delays in feedback or approvals from the client's side may affect the agreed delivery timeline.

Intellectual Property

Upon receipt of final payment in full, the client receives full ownership of the final deliverables created specifically for their project.

The Threefold Collective retains the right to:

Third-party assets (typefaces, stock photography, plugins, or licensed tools) remain subject to their respective license agreements. Ongoing licensing obligations become the client's responsibility upon project handoff.

Client Responsibilities

The client agrees to:

The Threefold Collective accepts no liability for project delays or issues arising from incomplete, inaccurate, or late client input.

Confidentiality

Both parties agree to keep confidential any proprietary, strategic, or sensitive information shared during the course of a project. This obligation remains in effect after the project concludes. Neither party will disclose the other's confidential information to any third party without prior written consent.

Disclaimer of Warranties

Our services are provided in good faith and with professional care. However, The Threefold Collective makes no guarantee that any website or digital product will achieve specific business outcomes, conversion rates, search rankings, or revenue results. Design performance depends on many factors — including your offer, audience, and market conditions — that are beyond our control.

Limitation of Liability

To the fullest extent permitted by applicable law, The Threefold Collective's total liability for any claim arising from our services is limited to the amount paid by the client for the specific project in question.

We are not liable for any indirect, consequential, incidental, or special damages — including lost revenue, lost data, or business interruption — arising from the use of our deliverables or services.

Termination

Either party may terminate a project agreement with written notice. In the event of termination:

Governing Law & Disputes

These Terms and Conditions are governed by the laws of the Republic of the Philippines. Any disputes arising from our services or these terms shall be subject to the jurisdiction of the appropriate courts in the Philippines.

For international clients, we will always seek to resolve disputes amicably and in good faith before any formal legal proceedings. Where required by applicable law in your jurisdiction, your local consumer protection rights are not affected by these terms.

Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. The most current version will always be published at thethreefoldcollective.com. Continued engagement with our services after an update constitutes acceptance of the revised terms.
